13 Questions Answered
Q. Can I file Form I-730 for my child listed on I-589?
A: Yes, you can still file Form I-730 for your child if you are granted asylum.

Even though you marked “No” on your Form I-589 regarding including your child as a derivative, and even though your child is now over 21, the Child Status Protection Act (CSPA) protects your ability to petition for him — as long as he was under 21 and unmarried at the time you filed your I-589, and he remains unmarried.

What matters is that:

-He was listed on your I-589,

-He was under 21 and unmarried at the time of filing,

-He remains unmarried now,

-And you file Form I-730 within 2 years of your asylum approval.

Marking “No” only means he wasn’t included as a co-applicant — it does not disqualify him from being petitioned for later using Form I-730.

You cannot amend your I-589 to add him now, but once you are granted asylum, you can file the I-730 without issue.

Q. Citizenship application & selective service registration mistake.
A: If you entered the U.S. at age 25 and 3 months, you were still within the Selective Service registration window (which ends at age 26). If you didn’t register and were required to, USCIS may ask for an explanation. However, if you actually entered after turning 26, then you were not required to register, and your answer on the N-400 is correct.

To be safe, bring documents like your passport, I-94, and a short written explanation to your naturalization interview. If needed, you can clarify that you believed you were exempt based on your age at entry.
Q. Denied firearm purchase with valid EAD and hunting license in Arizona.
A: Unfortunately, having a valid EAD alone—especially one based on a pending adjustment of status—does not meet the federal definition of lawful immigration status for firearm purchases under 18 U.S.C. § 922(g)(5). The hunting license exception typically applies to nonimmigrants on temporary visas (like B or F visas), not those adjusting status.

You may consider filing a NICS appeal through the FBI to review the denial, but in most cases like yours, the denial is consistent with current ATF policy. I strongly recommend consulting both an immigration and firearms law attorney before attempting another purchase, as making another attempt while ineligible could expose you to federal charg es. ...
