Q. Can I sue my landlord for an illegal eviction due to court paperwork errors and damages in CA?

A: I suggest you contact a tenant's rights lawyer as soon as possible to get help setting aside your eviction judgment on the grounds of fraud and/or mistake, based on the erroneous listing of your apartment. A good lawyer in that situation could leverage that case into a position where you could potentially settle for money damages, with the possibility of recovering attorney's fees as well. Time is of the essence because you probably need to move to set aside the judgment within six months of the date it was entered. If you delay beyond that point, you will likely lose your right to move to set aside the eviction judgment. So do not delay.

A: You very well could be. In order to determine whether you are, you need to contact the best civil rights lawyer you can find. Make sure you have a complete chronology of all of the events of your situation, naming all witnesses and describing all documents you have. Describe all the damages you have suffered as a result of the incident. Then make at least two copies of all your documentation, and retain the originals for yourself.

A: Make sure you prepare a chronological statement of what happened. Include all the details you can. You want to say what happened, where, how, when and why. Identify all the parties by name if you can, and if you have officer's badge numbers that would be beneficial. Retain all documentation you have or can obtain which relates to the incident.

You may want to make a report to the Tustin City Council and express your outrage and demand action. You might also contact the ACLU, as well as AJF legal support.

What happened to you is outrageous and cannot be tolerated. Take all the action you can under the circumstances.

If you incur any out-of-pocket expenses for medical or mental healthcare related to this matter, make sure you keep good records of all such treatment, including the providers. Keep all receipts for medical or mental healthcare you receive as a result of this incident. It appears to me to be a blatant civil rights violation, which begs redress.
