- Q. Can I sue my landlord for an illegal eviction due to court paperwork errors and damages in CA?
- A: I suggest you contact a tenant's rights lawyer as soon as possible to get help setting aside your eviction judgment on the grounds of fraud and/or mistake, based on the erroneous listing of your apartment. A good lawyer in that situation could leverage that case into a position where you could potentially settle for money damages, with the possibility of recovering attorney's fees as well. Time is of the essence because you probably need to move to set aside the judgment within six months of the date it was entered. If you delay beyond that point, you will likely lose your right to move to set aside the eviction judgment. So do not delay.
